These Terms of Service apply when you visit switchingjudy.co.uk, use the website or place an order. By using the website, you agree to these terms together with our Privacy Policy, Refund Policy and Shipping Policy.

USING THE WEBSITE

You must use the website only for lawful purposes. You must not misuse the website, introduce malicious code, attempt unauthorised access, interfere with its operation or use its content in a way that infringes another person's rights.

We may suspend or restrict access where reasonably necessary to protect the website, our customers or our rights.

PRODUCTS AND IMAGES

We take reasonable care to describe and display our products accurately. Colours and details may appear differently depending on screen settings, lighting and the natural characteristics of printed canvas and timber stretcher bars. Measurements are approximate unless stated otherwise.

Product availability may change. We may correct genuine errors in descriptions, prices or availability and will contact you if an error affects an order already placed.

ORDERS AND THE CONTRACT

Submitting an order is an offer to buy the selected products. An automated acknowledgement confirms that we have received your order; it does not necessarily mean that we have accepted it. A contract is formed when we send confirmation that the order has been accepted or dispatched.

We may decline or cancel an order where a product is unavailable, payment is not authorised, the price or description contains an obvious error, delivery is not available to the supplied address, or we reasonably suspect fraud or misuse. If payment has already been taken for a cancelled order, we will refund it.

You are responsible for providing complete and accurate billing, delivery and contact information. Please contact us promptly if any information is incorrect. We cannot guarantee that an address can be changed after production or dispatch has begun.

PRICES AND PAYMENT

Prices are shown in pounds sterling and include applicable UK taxes unless stated otherwise. Delivery charges are shown at checkout before payment. Available payment methods are displayed at checkout and may be provided by third-party payment services.

We may change future prices at any time. Changes will not affect an order we have already accepted, except where there is an obvious pricing error that we bring to your attention.

PRODUCTION AND DELIVERY

Our canvases are produced to order in the UK. Current production, dispatch and delivery information is set out in our Shipping Policy and may also be shown on the product page or at checkout. Delivery dates are estimates unless we expressly agree a guaranteed date in writing.

Risk in the products passes to you when they are delivered to you or to a person you nominate. Ownership passes when we receive payment in full.

CANCELLATIONS, RETURNS AND FAULTY PRODUCTS

Your cancellation and return rights are explained in our Refund Policy. Nothing in these terms limits your statutory rights, including your rights when goods are faulty, damaged, not as described or not fit for purpose.

INTELLECTUAL PROPERTY

The website and its content—including artwork, product imagery, photographs, text, branding, graphics and design—are owned by or licensed to us and are protected by intellectual-property law.

Purchasing a product does not transfer copyright or any other intellectual-property rights. You may not reproduce, download, copy, distribute, modify, sell or commercially exploit website content or artwork without our prior written permission, except where the law permits.

THIRD-PARTY SERVICES AND LINKS

The website may use or link to services operated by third parties, including Shopify, payment providers and delivery providers. Their own terms and privacy practices may apply. We are not responsible for third-party websites that we do not control.

LIABILITY

We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.

We supply products for private and domestic use. If you use a product for a commercial or business purpose, we are not liable for loss of profit, loss of business, business interruption or loss of business opportunity, to the extent permitted by law.

We are not responsible for delay or failure caused by events outside our reasonable control. If such an event materially affects your order, we will contact you and take reasonable steps to minimise the effect.

We may update these terms from time to time. The version published when you place an order will apply to that order. The latest version will be available on this page.

These terms are governed by the laws of England and Wales. If you are a consumer living elsewhere in the United Kingdom, you retain any mandatory protections provided by the law where you live and may bring proceedings in your local courts where applicable.
